Yes, I know it began a long time ago, but since the passing of the Military Commissions Act of 2006 a couple days ago, the Bush administration has been very quick to notify the courts that they no longer have jurisdiction to consider hundreds of Guantanamo Bay cases.
People don't seem to be getting it. The law and justice has lost, and the Bush administration has won.
What we're going to see from this point on is more and more of the law being pushed aside in favour of what the Bush administration wants. The law will only apply to those who have no power.
The new law already has been challenged as unconstitutional by lawyers representing the petitionersI guess someone forgot to tell them that the constitution no longer matters.
Whichever side loses in the upcoming court battles, he said, will then appeal to the Supreme Court.Why bother? The Supreme Court has already ruled on unlawful actions by the US government, stating that unlawful actions must be approved by Congress. What use is law and the constitution when Bush can get Congress's approval to ignore laws and the constitution as he sees fit?
